The Supreme Council of the Judiciary (CSM) has launched an investigation into Judge Carlos Alexandre for possible breach of duty in the EDP case, an official source in the body told Luce on Wednesday.
This is the certificate obtained by the CSM, confirmed by the body for the management and discipline of judges on June 7, based on the recent decision of the Court of Appeal of Lisbon (TRL), in which the judges ordered the return of the old-age pension. 26,000 euros to former Economy Minister Manuel Piño, who was arrested by order of a judge at the Central Criminal Court (TCIC).

The report sent to TRL reports a “situation that may constitute a breach of ‘(…) the duty to comply with decisions rendered on appeal by higher courts’ (…) in relation to Mr Justice Carlos Alexander.” .

Thus, the judges understood that this action by the investigating judge “may constitute a breach of the ‘duty of execution of decisions rendered on appeal by higher courts’”, as stated in the latter judgment.
The former minister’s pension was seized to secure the payment of five million euros, but TRL stressed that the order, contested by Manuel Piño’s defense, did not indicate the market value of assets that had already been seized.
This order also ordered the TRL to return items seized during searches of the former minister’s home on November 3 (wine, handicrafts, a pinball machine and a bag of golf clubs), since “no reference was made to the fact that the assets, those arrested in this case are the instruments of the indicted crimes or their products.”
Former Minister of Economy (between 2005 and 2009) Manuel Piño will answer in the EDP trial for the crime of passive corruption for a wrongful act, another crime of passive corruption, the crime of money laundering and the crime of tax fraud.
