The court of Santa Maria da Feira sentenced a 22-year-old to four years of probation for violently assaulting a classmate in Oliveira de Azemeis, Aveiro district, in 2018.
According to the verdict seen by Lusa today, the young man was acquitted of the offense of refusing assistance, but found guilty of a serious offense against physical integrity, with a suspended sentence of four years in prison.
The suspension of the sentence was due to the probationary regime and the obligation of the defendant to pay the victim 100 euros per month on account of the compensation awarded.
The court also partially satisfied the claim of the victim for civil compensation, awarding the defendant to pay him about 340 thousand euros for material and non-pecuniary damage.
He was also ordered to pay each of the victim’s parents a total compensation of 15,900 euros and about 385 euros to cover hospital expenses.
The events took place on November 30, 2018, around 8:40 am, next to the bus stop located opposite Escola Secundária Dr. Ferreira da Silva, Cucujins, Oliveira de Azemeis.
According to the proven facts, the defendant and the offended party, who at that time were 17 years old, quarreled and became physically involved in the exchange of “mutual pushes”.
After that, the defendant “inflicted at least two punches and two knees on the face/head, as well as kicks on various parts of the body, several punches and kicks on the head and other parts of the body when he was already lying on the floor.”
“After these attacks, the victim lay on his face, could not get up and began to lose consciousness and feelings,” the verdict says.
After an argument, the defendant left the place next to the bus stop and went inside the school without first providing any assistance and without calling for medical assistance to the victim.
Some people who were present and witnesses of the events called firefighters, who provided first aid and took the young man to the Santa Maria da Feira hospital, from where he was transferred to the Centro Hospitalar de Vila Nova de Gaia, where he was already in serious condition. coma.
It was also proven that the victim sustained a head and neck injury with subsequent cerebrovascular accident (CNS), which had irreversible consequences in terms of speech and mobility.
