The announcement of the decision in the case of the attack on a young girl in the Fafe nightclub has been postponed

Sentencing in the case in which five defendants are responsible for the attempted murder of a young man outside a nightclub in Fafe has been postponed to October 13.

The court amended the charges against them, and the defendants’ lawyers asked for time to consider them.

Let us remind you that everything happened in May 2022 due to a series of disagreements.

The case initially involved six defendants, five men and one woman, aged between 20 and 36, all Brazilian citizens, but at the first hearing the court separated three defendants: one because he was still at large, a woman and a man because they did not appear in court and are in unspecified custody.

The main case then involved two defendants in pre-trial detention and one who is at large but prohibited from leaving the country, accused of co-authorship of qualified attempted murder, as well as several crimes against qualified physical integrity.

The presiding judge explained today that, taking into account the evidence and testimony presented at the trial, in addition to the defendants’ intervention in the attacks, there was also the participation of two more men and a woman, without, however, specifying whether they were the three defendants who were separated from this trial.

The chairman of the panel of judges spoke of “extreme violence” and the desire to kill the victim on the part of those involved for “minor reasons.”

At the closing arguments, held on July 11, the Office of the Public Prosecutor (MP) demanded exemplary sentences for the defendants.

“Given the seriousness of the facts, the verdict should become an example for other citizens, especially young people. [para que percebam] that these facts are strictly punished and cannot happen. There are no justifications,” said the deputy prosecutor, defending the effective conviction of the defendants, exceeding the minimum provided for by criminal law.

According to the MP, following the facts, two of the members of the group that brutally attacked a 24-year-old young man outside the Mamma Mia nightclub in S. Gens, Fafe, in the early hours of May 29, 2022, fled to Brazil and the Netherlands.

However, the suspect, who fled to the Netherlands, was detained in Lisbon and will be tried separately.

The deputy’s indictment states that on the morning of that day, a group consisting of the main victim, another young man and two young women went to the Mamma Mia nightclub, where a group of six accused were already present.

The prosecutor recalled that when the victim left the club, “the defendants were already waiting for him and the attacks began,” adding that at no stage of the trial were there any confessions or remorse from the defendants.

The deputy states in the indictment that “as a direct and necessary consequence of the conduct” of the defendants, the victim “sustained a traumatic brain injury and a maxillofacial injury, both severe, underwent emergency surgery in the specialty of neurosurgery, and was placed in an induced coma.”

The young man spent more than four months recovering from his injuries but was left with a “permanent scar”.

In their closing statements, the defendants’ lawyers, for their part, asked to change the legal classification of the crime of murder into an attempted crime against physical integrity, accusing the court of wanting to “put everyone in one bag, as if they were being tried for a criminal association.”
