Suspended sentence for young man who tried to kill a tourist in Peniche

The Leiria Judicial Court sentenced a young man to one sentence of five years’ imprisonment, suspended, for attempted murder of a tourist in Peniche and petty human trafficking.

The panel of judges found that on August 23, 2022, the victim and several friends had dinner at a restaurant, from which they left at 00:20.

“The defendant also knew that the amount of hashish he had was in excess of what was permitted by law,” he said.

The foreign tourist was then transferred to Caldas da Rainha Hospital, where he underwent surgery to remove the dagger.

The collective court sentenced the defendant to four years and six months’ imprisonment for attempted murder and to 18 months’ imprisonment for trafficking in minors, which carried a statutory penalty of five years’ imprisonment, suspended for the same period, with probation .

A reduction in sentence under the regime applicable in criminal cases to young people aged 16 to 21 years was rejected.

The defendant, who has no criminal record and will await release for the decision to take final effect, was also ordered to compensate the tourist 20 thousand euros plus interest for non-pecuniary damage.

One of the judges who was part of the collective court voted against the decision to suspend the sentence, taking into account the “seriousness of the acts committed, the unjustifiability of aggression, the lack of remorse and remorse,” as well as the “very high requirements for general prevention.”

On the last point, the judge noted “the increasing frequency of offenses of this type, especially at night, on public roads and, in this case, among tourists, in most cases with tragic or irreversible consequences.”

On the other hand, he emphasized the “special requirements for the prevention of this case”, concluded that the suspension of execution of the prison sentence “does not sufficiently achieve the purpose of punishment”, voting in favor of maintaining the coercive measure. stay at home under electronic monitoring.

The judge also considered that in the case of a minor crime of human trafficking, consideration should be given to the use of the law, which provides for pardon of sentences and amnesty for offenses as part of World Youth Day.
