The sentences requested by the Ministry of Justice for those involved in the death of Sarah Carreira are now known.

The trial for the death of singer Sara Carreira has returned to the Santarem court. Closing arguments took place this Friday.

Tony Carreira was not present but was represented by lawyer Magalhães y Silva.

Let us remember that Sarah Carreira, the daughter of Tony Carreira, died on December 5, 2020 in a fatal accident on the A1 highway. Paulo Neves was driving drunk at a speed of about 30 kilometers per hour. Fado singer Cristina Branco collided with her car. Ivo Lucas and Sara Carreira were speeding, as was Thiago Pacheco.

Lawyer Thiago Pacheco simplifies the investigation

Lawyer Tiago Pacheco says the study is unreliable. “We are not going to assign the title of expert to a citizen who diligently conducted an investigation for 3 months and went to film,” he says.

“Ivo Lukas did not whistle aside”

Ivo Lucas’ lawyer expressed regret for calling the defendant guilty and said Ivo “didn’t whistle or show any lack of remorse.”

“The only one who didn’t have the normal visual warning was Ivo Lucas,” says the defense.

Cristina Branco’s lawyer: “Talk about distraction is pure speculation”

Cristina Branco’s lawyer said that the attitude of the defendants is incomparable. It says that Christina was speeding, without alcohol and in the right lane.

“Talk of distraction is pure speculation,” he says, adding that “there was a serious flaw in the analysis.”

“The actions of Paulo Neves in themselves would not have led to Sarah’s death,” the defendant’s defense says.

Paulo Neves’ defense argues that there are two essential facts: driving under the influence and driving below the speed limit on the motorway.

“Paulo Neves’ actions alone would not have led to Sarah’s death,” he adds.

Magalhães e Silva apologizes to Paulo Neves for calling him drunk.

Tony Carreira’s defense criticizes Ivo Lucas’ carelessness in the crash that killed Sarah Carreira

Tony Carreira’s lawyer Magalhães e Silva speaks of apology and respect. He states that this would achieve social peace, which will only happen after the verdict.

He adds that Tony doesn’t want compensation and that “this family’s mourning must end.”

As for Ivo Lucas, Magalhães e Silva says that he talks about the video and states that several cars passed by the scene of the accident and therefore Ivo could have avoided the accident.

The lawyer claims that Paulo Neves was drunk and acted like a “virtually motionless object.” Fernanda Antunes, Sarah Carreira’s mother, wears sunglasses and is very attentive.

Magalhães e Silva says that fado singer Cristina Branco, like Ivo, also did not know about it.

Tony’s defense adds that you can’t “whistle sideways” and that in this case, “you hug, shake hands and apologize.”

He also noted that the punishments proposed by the deputy seem to be adjusted.

The prosecutor’s office believes that all defendants should be convicted of the crimes of which they are accused. Paulo Neves shakes his head. “All three bear fatal responsibility for this event,” says the prosecutor.

“It’s like trying to shift the blame onto each other. Everyone is whistling to the side,” he continues.

For Paulo Neves, the deputy is asking for 3/4 of the maximum sentence of 5 years in prison, that is, more than 3 and a half years for gross negligence murder. This is a suspended sentence.

Cristina Branco should be given a suspended sentence of more than one year.

For Ivo Lucas, the deputy is asking for a suspended prison sentence of more than 2 and a half years, more than half the maximum sentence, for gross negligence murder.

And Thiago Pacheco faces a fine.

The Ministry of Justice also asked for one-year suspensions for Ivo Lucas, Paulo Neves for one year, Cristina Branco for 6 months and Thiago Pacheco for 4 months.

The prosecutor’s office begins by expressing condolences to Sara’s parents and grief over the loss of Ivo. He talks about accidents that have occurred in recent years and states that in the last 10 years, 500,000 people have been injured in accidents, which means 5% of the Portuguese population.

‘A picture is worth a thousand words’: The deputy says the images prove there was no fog at the time of the accident, at 6:44 p.m., visibility was two kilometers, and it was raining, but at the time it was raining lightly and not causing any obstruction.

“Judging by the statements of Paulo Neves, the first collision occurred at 18:44, and just three hours and 46 minutes later an alcohol test is carried out, which gives 1.18 grams per liter of blood,” the deputy adds. noting that the defendant was snacking – drinking wine and eating cheese – but did not specify how many bottles he drank.

Paulo Neves’ alcohol test was carried out at 10:30 pm at the hospital. The prosecutor shows a study in which there is a graph analyzing the absorption of 0.75 liters of wine.

“What the defendant Paulo Neves did was zero,” says the deputy. Remember that the defendant said he was shaking, but he should have gotten out of the car and raised the triangle to indicate the accident. Paulo Neves was driving at a speed of 28 kilometers per hour.

The deputy adds: “The collision occurred because Christina was also distracted. She did not notice the car in front of her and did not move to a safe distance.”

Christina’s car immediately activated four flashing lights, but the deputy admits they could have activated automatically. The prosecutor also claims that Ivo did not notice Christina’s car because he was distracted.

“Ivo’s car drove 500 meters, not realizing that there was an accident ahead. Christina’s car was flagged,” adds the deputy.

As for Thiago Pacheco, the deputy states that it is “obvious” that he was driving at a speed of 150 km/h and overcame several obstacles on the road.

A witness called by Ivo Lucas speaks in court

A friend of Ivo Lucas is now speaking in court. He calls Ivo “an extremely empathetic person” and “very humane.”

“It had a huge impact on Ivo’s life, before Ivo’s eyes started shining, he was happy, in love, at a great stage in his life,” he says.

Ivo’s friend adds that “it’s very difficult to explain” when he saw Ivo being transferred from the hospital. He recalls that their friendship has lasted for 15 years, and states that he still sees “a lot of pain” in Ivo.

Cristina Branco makes a request

Defendant Cristina Branco requested clinical information from her therapist confirming that she had difficulty talking about facts and that she had amnesia regarding part of the incident. The judge says he is allowing the statement to be added to the case file because it is relevant to the trial.
