Portuguese artists included in evidence in US case against artificial intelligence services

At least five Portuguese artists are among more than 4,700 whose work was used without permission and are included as evidence in a copyright lawsuit against artificial intelligence services in the United States.

Add Fuel (Diogo Machado), Jorge Jacinto, Nadir Afonso, Regina Pessoa and Vils (Alexandre Farto) are Portuguese artists whose names appear on this newly published list, which also includes Berriblue, a Polish-Irish artist based in Portugal since 2015 of the year. and André (Saraiva), son of Portuguese parents, born in Sweden and raised in France.

In a lawsuit originally brought by illustrators Sarah Anderson, Kelly McKernan and Carla Ortiz, companies Midjourney, Stability AI and DeviantArt are accused of using artwork available online but protected by copyright to train the tools they use. Artificial intelligence for image creation.

On October 30, part of the indictment was dismissed. However, the court allowed the illustrators to file a new motion to continue the process, which was filed the next day.

Then the court provided 30 days to present new evidence.

That’s exactly what happened on November 29, when 15 more tests were accepted, including sample images created by artificial intelligence companies, original images and a list of artists in question.

With this new evidence presented, the case is now against four companies (Midjourney, Stability AI, DeviantArt and Runway AI), and the number of plaintiffs has grown to ten artists: three illustrators, plus Gregory Manchess, Adam Ellis, Gerald Brom, Grzegorz Rutkowski, Julia Kaye , H. Southworth and Jingna Zhang.

The list of artists whose work was used without permission included in the tests covers more than 4,700 names, including painters, filmmakers, illustrators, painters, sculptors, caricaturists, comic book writers, graffiti artists, and includes, in addition to Portuguese artists, others such as Andy Warhol, Jean-Michel Basquiat, Cinema, Peyo, Jonas Mekas, Wei Wei, Vincent Van Gogh, Os Gemeos, Miss Wang, Mauricio de Souza, Max Ernst, Man Ray, Joan Miró, David Lynch, Frida Kahlo, Emily Carr, Debbie Hughes and Bill Watterson.
