Lawyer Astrid Wagner said the move paves the way for the conditional release of Josef Fritzl, now 88 and suffering from dementia.
The man known as the “Monster of Amstetten” had seven children with his daughter Elisabeth during the years he kept her imprisoned in the basement of his home. In 2009, he was sentenced to life in prison for the kidnapping, rape, incest, enslavement and negligent homicide of one of his children.
Wagner argues that Fritzl truly regrets his crimes and that “since he is no longer a danger,” he should be able to leave prison and go to a nursing home where he will be treated with “human dignity.”

Josef Fritzl sexually abused Elisabeth from the age of 11. In 1984, when his daughter turned 18, he lured her to the basement of the family home and told everyone that the young girl had run away to join a cult.
During her captivity, Elizabeth was subjected to inhumane conditions and was raped several times by her father, who eventually became pregnant seven times.
Josef Fritzl’s crimes became public knowledge when one of the children he had with Elisabeth became seriously ill and had to be taken to hospital.
The case received widespread media coverage due to the length of time the victim was imprisoned, as well as all the crimes committed by Josef Fritz during this period.
