The Court of Arbitration for Sport (TAD) said on Tuesday that Sporting striker Paulinho has been cleared of a two-game ban for his sending off in the Football League Cup final against Porto in January 2023.
In the final, which the Lions lost 2-0 to Porto in Leiria, the striker was sent off after receiving two yellow cards, in the 63rd and 71st minutes, leading to a penalty kick.
The striker was also punished with a further two-game suspension for words addressed to the refereeing team led by Joao Pinheiro when leaving the field, but Sporting appealed the decision.
First, the Disciplinary Council (CD) of the Portuguese Football Federation (FPF) in its entirety, which rejected the appeal and, having already played two games [frente a Sporting de Braga e Rio Ave]for TAD, together with the precautionary measure that was granted by the South Central Administrative Court (TCAS), suspending the third game of the penalty.
“This arbitration panel decides to grant amnesty for the offense for which the applicant was punished by the respondent in summary proceedings of January 31, 2023, namely the sanctions of a two-game suspension and a fine of EUR 2,555.00 for the alleged disciplinary practice. a violation under Article 158 (a) of the Disciplinary Regulations of the Portuguese Professional Football League,” TAD said in a statement released today.
The decision is based on Law No. 38-A/2023, which established pardons of sentences and amnesties for offenses on the occasion of World Youth Day in Portugal in the presence of Pope Francis.
“The violation entailing disciplinary punishment was committed on January 28, 2023 (the day of the game between Sporting of Portugal – Futebol SAD and Futebol Clube Porto – Futebol, SAD, counting for the League Cup); on the other hand, the violation is not simultaneously a criminal offense not amnestied by the relevant law, and the applicable penalty does not exceed disciplinary suspension or imprisonment. Thus, the facts underlying the violation in question fall under the assumptions for the application of the said Law No. 38. -A/2023 of August 2, without any exceptions,” TAD clarifies.
