A Continente employee who left work with a plastic bag without pay on June 25, 2021 was suspended for 15 days and deprived of half his salary and corresponding seniority. The theft cost the establishment two cents.
How JN, A hypermarket employee with the category “specialized operator” was detained by a security guard at the exit from the establishment with a plastic bag containing his work uniform.
The employee, who returned the plastic bag when he was caught, sued the company and demanded compensation for moral damages in the amount of 3,500 euros. The Sintra court disagreed, and the employee appealed to the Lisbon court, which qualified the employer’s actions as “disproportionate.”
Continente appealed the verdict because it considered that the employee had misappropriated “an asset belonging to the employer without his permission or consent” and that his conduct was “reprehensible”. The Supreme Court concluded that the worker’s wages had “already been reduced” and that the sanction was disproportionate to the cost of the theft.
