Supreme Court clarifies that Marcelo Rebelo de Sousa is not involved in the Portuguese-Brazilian twins case

This Friday, the Supreme Court clarified that Marcelo Rebelo de Sousa is not involved in the case of Portuguese-Brazilian twins being treated at the Santa Maria Hospital.

Following the public news of a case sent to the Supreme Court and received from the Central Criminal Court, with a ruling in which what is at stake is “the investigation of facts that may fall within the jurisdiction of the Supreme Court”, understanding, in theory, that the existing suspicions regarding Dr. Nuno Rebelo de Sousa can be extended to his father – His Excellency the President of the Republic – it is important to clarify the following:

1 – In accordance with the Constitution of the Portuguese Republic, the Public Prosecutor’s Office is the initiator of criminal proceedings and is responsible for initiating criminal proceedings and taking appropriate measures for this purpose;

2 – According to information received from this judicial body, His Excellency the President of the Republic has not been prosecuted in the relevant proceedings and there is no suspicion or accusation against him of committing any illegal acts;

3 – Since there was no suspicion, according to information repeatedly received from the prosecutor’s office, the Supreme Court had nothing to determine;

4 – Finally, it is worth remembering that according to Articles 130, no. 2 and 163, al. c) both the Constitution of the Portuguese Republic and Article 33, No. 2 of Law No. 34/87 of July 16, the Assembly of the Republic has sole responsibility for initiating and promoting the process of prosecution against. the president.

Thus, in view of the absence of suspicions and accusations of committing any criminal offense and taking into account what is stated in paragraph 4 of this application, the petition for the measures requested by the criminal investigation judge was not considered, the case is returned to the first instance.
