Two prisoners sentenced to seven years in prison for attempting to kill another in prison

The Leiria Judicial Court sentenced two prisoners to seven years and seven and a half years in prison for the offense of qualified murder in the form of attempted murder of another in the Leiria Youth Prison.

Another defendant, also a prisoner accused of the same crime, was acquitted.

In a ruling handed down on Monday and accessed by Luz’s agency on Tuesday, a panel of judges found that the victim was placed in that prison on March 22, 2021, with a preventive measure of alleged crimes of sexual coercion, rape, sexual harassment and pornography of minors. .

Two prisoners, one aged 22 and the other aged 21, this foreigner, “informed of the crimes” of which this detainee was accused, “decided by common consent and joint efforts to take his life”.

In the facts recognized as proven, the court refers to the fact that the next day the accused, now acquitted, approached another prisoner, offering him to participate in the murder “in exchange for 200 euros”, which he refused.

On March 24, two convicts “waited for the end of the victim’s break” and for her to go to take a shower in the spa. There she was pushed and seized, one of them put a sock around her neck and with both hands squeezed her hard, strangling her until she lost consciousness.

“A few moments later (…) he regained consciousness, and at that moment “one of the defendants” cut his neck with a blade, and the other “was behind him, grabbing his hands,” it says. judgment.

Two prisoners left the locker room, and the victim, despite being injured, “knew how to get up and walk” bloodied to the door of the locker room, losing consciousness. She was rescued and taken to a hospital in Leiria where she was operated on and then transferred to a hospital in Caxias.

The panel of judges believes that the defendants, who were both serving sentences in different prisons, acted “in concerted and joint efforts, putting into practice the plan they had developed to end the life” of the victim. “considering the tool used and the body part they hit”, which they were unable to do “for reasons beyond their control, mainly because” she was saved.

The court points out that the two “acted in disrespect and utter disrespect for the life” of the detainee, “desiring to take his life for preventive detention for sexual offences”, noting that “the numerical disproportion between them” and the victim prevented him from defending himself.

The foreign defendant, who was sentenced to seven years in prison, also faces the additional penalty of expulsion from the country with a ban on entry for five years.

The Collective Court also granted in part the civil action brought by the Centro Hospitalar de Leiria, jointly awarding the two defendants EUR 8,671.35 plus interest.
