The government changes the support requirements for the return of expats to Portugal

The government has once again amended the Diploma for Supporting the Return of Emigrants to Portugal, specifying, for example, that recipients must present employment that began in Portugal between January 2019 and the end of the program.

According to the ruling, published on Tuesday in Diário da República, one of the conditions for recipients of this support is now the requirement that they start working in the Portuguese mainland between January 1, 2019, until the end of the Regressar program.

Before this change, it was required to start work, having concluded an employment contract, in the period from January 1, 2019 to December 31, 2020.

The executive branch also determined that the beneficiaries must be emigrants who left Portugal for at least three years “relative to the date of commencement of employment for which the application is directed”.

As part of the start date change, indefinite employment contracts entered into between January 1, 2019 and the end of the program are now eligible, while prior to that period ended in December 2020.

This also includes the establishment of companies or self-employment in the Portuguese mainland starting from January 1, 2019 until the end of the program period, scholarship contracts, fixed-term employment contracts for a period equal to or greater than 12 months, and fixed-term contracts with a duration, equal to or greater than 12 months.

The Government also ruled that employment contracts concluded with organizations that do not have a registered activity in Portugal are unacceptable, as well as contracts that relate to “situations of the return of a worker posted abroad, except, in the first case, situations in which a certain contract, the workplace or professional activity carried out independently is located inland”.

With regard to financial support, the diploma states that recipients who meet the specified requirements are eligible for support in the amount of six times the Social Assistance Index (IAS).

The ruling, published on Tuesday, clarifies that the formula applies to employment contracts for an indefinite period, “or when it comes to setting up companies or the job itself.”

On the other hand, support is five times the IFRS value for fixed-term employment contracts equal to or greater than 12 months, or for indefinite employment contracts equal to or greater than 12 months. months.

The financial support provided for in paragraphs one (six times the cost of IFRS) and two (based on a 40-hour working period, the support is reduced in the appropriate proportion) is increased by 10% for each member of the recipient household who settles in Portugal, but no more than three times the cost of IAS.

In this context, it has been determined that the contribution of the cost of travel to Portugal by the recipient and the rest of the household begins to be treated as a fixed amount of 0.75 of the AAI cost for each household member, for travel from Europe, and from 1.25 for travel from outside Europe.

The cost surcharge for transporting goods to Portugal is capped at three times the IFRS cost per aggregate, while the cost surcharge for recognition of academic or professional qualifications in Portugal is capped at 1.5 times the IFRS amount “upon presentation of proof of expenses”.

Paid financial support corresponds to 50% of the approved amount within 10 working days after delivery of the acceptance deadline and the remaining documentation; up to 25% of the total amount approved in the seventh calendar month after the start of the employment contract, and up to 25% of the total amount in the 13th month after the start of the contract.

The Government also clarified that in connection with the termination of a work assistance contract or the termination of an employment contract under the agreement “there are no grounds for the return of alimony if the recipient submits to the IEFP [Instituto do Emprego e Formação Profissional]within 30 working days from the date of termination of the employment contract, a new employment contract, on a full or part-time basis.

The measure, signed by Labor Minister Luis Miguel Fontes, takes effect on Wednesday.
