The TSJPV endorses the fee for trucks on the N-1 and A-15 in Gipuzkoa

The toll system, in force since the beginning of the year, was appealed by the Spanish association of carriers, Fenadismer, and unlike previous occasions (it has been struck down twice), the court has ratified its legality.

The High Court of Justice of the Basque Country (TSJPV) has endorsed the fee established by the Gipuzkoa Provincial Council for heavy vehicles along the entire route of the N-1 and A-15rejecting almost in its entirety the appeal against the foral regulation presented by the National Federation of Transport Associations of Spain, Phenadismer.

The new toll system for heavy vehicles entered in force in Januaryreplacing the two previous ones that were knocked down by the courts in 2018 and 2021.

The decision has been made known by Fenadismer itself. In a note, the carriers’ association points out, however, that the court has partially proved rightsince the TSJPV has estimated that the foral norm violates the European regulation by not taking into account discounts for less polluting vehicles.

However, the Provincial Council itself Gipuzkoa corrected this point in DecemberTherefore, as Fenadismer admits, “in practice the effects of this new sentence will not paralyze its application” .

According to the regulation, trucks and cranes with efficient engines will benefit from discounts ranging from 15% to 25% on the rate, depending on the type of engine. To this discount will be added in October the frequency discount, which includes discounts of up to 13%.

According to the association, “tolls in Gipuzkoa are among the highest in Europe. Thus, compared to Germany, today they are between 30 and 40% higher, today even 50% compared to those of Belgium, despite the fact that the income level in both countries is much higher than here”.
