This Wednesday, the President of the Republic promulgated a parliamentary decree strengthening the protection of victims of crimes against sexual freedom.
A note published on the website of the President of the Republic states that Marcelo Rebelo de Souza “promulgated a decree strengthening the protection of victims of crimes against sexual freedom by amending the Penal Code, Law no. 34/2004. , of 29 July, and the Statute of the Injured”.
The mentioned diploma was approved about a month ago unanimously by the Assembly of the Republic on the initiative of PS.
Retaining the semi-public nature of the crime of rape, the decree provides that “when committing the crimes provided for in Articles 163.º [coação sexual] and 164th [violação] depends on the complaint, the prosecutor’s office may initiate it within one year from the date on which it became aware of the fact and the persons who committed it, when the interests of the victim so require.
The diploma, which was being worked on by the Parliamentary Commission on Constitutional Affairs, Rights, Freedoms and Guarantees, also determined the extension of the period during which a complaint can be filed from the current six months to one year. It was also determined to create a greenway to access the law, exempting victims from proving economic insolvency, similar to what happens to victims of domestic violence.
