The judges of the provincial court in Barcelona decided to “acquit” Neymar and eight other defendants in the same process, considering the lack of evidence of the offense, and, therefore, “damage to the plaintiffs”.
In addition to Neymar, the defendants included his parents, former FC Barcelona presidents Sandro Rosell and Josep Maria Bartomeu, former Santos manager Odilio Rodriguez and a career management company.
This Monday’s decision comes a month and a half after Spanish prosecutors dropped all corruption and fraud charges against Neymar in connection with alleged wrongdoing linked to the Brazilian footballer’s transfer to Barcelona in 2013, as he considered them “assumptions”. “no ‘evidence’.
The 30-year-old Brazilian striker, who now plays for Paris Saint-Germain, has been put on trial for alleged corruption and fraud in his 2013 transfer from Santos to Barcelona, as well as his father and manager Neymar da Silva.
Prosecutors then dropped “the charge against all the defendants and on all the facts” of which they were accused, having previously requested two years in prison and a fine of 10 million euros against the Brazilian footballer.
Prosecutor Luis Garcia justifies this decision by arguing that the charges “were based not on evidence” but on “presumptions” and that the case fell under civil rather than criminal justice.
The case was initiated by a complaint from DIS, which owned 40% of Neymar’s rights when he played for Santos and sued him in June 2015, alleging that the player, his family and Santos concealed the real cost of the transfer. to the detriment of this company.
DIS originally asked for five years in prison for Neymar and compensation of 35 million euros, but after the MP dropped the charges in October, he decided to reduce the requirement to two and a half years.
