The Public Prosecutor’s Office (MP) asked the Supreme Court (STJ) to increase the number of prison sentences to which more than 80 defendants in the Hells Angels case were sentenced by the Loures Criminal Court.
In the appeal, which Lusa had access to this Wednesday, the deputy said he “absolutely disagrees with the assessment” of the Loures court regarding “the circumstances in imposing the single prison sentence imposed on each of the accused.”
Therefore, he asks STJ to impose a solitary prison sentence of 15 to 19 years for each of the Colored Flowers/Hells Angels defendants, with “higher sentences for those in leadership positions.”
For defendants who are “on track to become members of the Hells Angels,” called “parties” and “prospects,” prosecutor Paula Santos is seeking a single prison sentence of the maximum legal age of 14 to 15 years and three months in prison .
The sentences now requested represent aggravated punishment, as the Loures court sentenced 86 of the 88 defendants to terms ranging from one year to nine months (suspended) and 15 years and six months in prison.
In the final arguments of the trial court, the deputy argued that a single prison sentence should not be less than 17 years for the leaders of the organization and 15 years for the rest; according to the decision of the panel of judges, chaired by Sara Pina, it turned out to be more favorable, not exceeding 15 years and six months in prison.
Regarding the conviction of several defendants, the deputy complains that “it is not clear how the single punishment applied to each of the defendants (…) was established between 1/3 and slightly above 1/2 of the applicable abstract framework. “, compressing, in the opinion of the deputy, in an “unacceptable manner” the specific sentence to which each of them was sentenced” in the first place.
In the appeal now presented, prosecutor Paula Santos emphasizes the “very high requirements for prevention”, taking into account the crimes in question, namely criminal association, extortion, attempted murder, robbery, possession of a prohibited weapon.
The MP’s appeal is addressed directly to the STJ and not to the Lisbon Court of Appeal (TRL) as it is merely a question of law, but Melo Alves, a lawyer associated with the case, told Lusa that the defendants’ defense appeals would be heard. that all issues will be analyzed by TRL and not by the Supreme Court.
The Hells Angels case involves hundreds of crimes, including attempted murder, criminal association, possession of prohibited weapons, extortion, robbery, drug trafficking and drug use.
