Former member of Santa Casa demands from the Ministry justification for dismissal

Santa Casa da Misericórdia board member João Correia, who was fired on April 29, asked the labor minister for a document for judicial purposes containing “all but all the facts that justify the charges” of dismissal.

In a request sent today to the Minister of Labour, Solidarity and Social Security, to which the Luz agency had access, lawyer João Correia argues that the grounds for the dismissal of the members of the board of Santa Casa da Miseriórdia de Lisboa (SCML) are “vague, general and only convincing”, and also damage his good name.

The attorney is also asking that the “clarification order” requiring council members remain in office be invalidated because he believes it is “unlawful and per se constitutes a criminal offence,” arguing that it is based on standards that no longer apply.

On May 2, the Ministry of Labor warned the dismissed SCML administration to remain in office on pain of committing the crime of abandoning government functions.

According to the former member, the order to dismiss five council members (4702-C/2024 of April 29) justifies the termination of functions by the lack of provision of the necessary elements, namely “lack of information in the guardianship and guardianship authorities.” regarding the report and reporting for 2023, even in a preliminary version, about the implementation of the budget for the first quarter of 2024, the lack of response to requests for information and serious negligent acts affecting the management of the institution.

Maria do Rosario Ramalho’s ministry also claims that leading elements of the SCML have not presented any “financial restructuring plan, taking into account the imbalance of accounts between the current structure and the capital structure, since they took office until now.”

According to João Correia, the lawyer handling his own case, the reasons for his dismissal were unfounded, which is why he requested from the ministry “a certificate for judicial purposes containing everything but all the facts justifying the charges.”

According to the former leader of the SKML, “they are unable to disclose even the reasons for the dismissal of each member of the Council”, as well as “any connection between the accepted motivation and the behavior and responsibilities of each of the individuals persecuted.” because the “pelures” did not match.”

In the statement, João Correia refers to his 50-year status as a lawyer and recalls some of the positions he has held – Secretary of State for Justice, Vice-President of the General Council of the Bar Association and member of the High Council of the Ministry of State. , warning that “public harm may result from such allegations” as are included in the dismissal order.

Ombudsman Ana Jorge and the five remaining SCML board members were dismissed “with immediate effect” on April 30, based on an order that justified the decision for “serious negligent acts” that affected the institution’s management.

Following her dismissal, the supplier wrote a letter to all SCML employees, accusing the government of firing her in a “rude, arrogant and slanderous manner” and saying she was caught off guard.
