Tenants will now be able to notify the tax authorities of leases, subleases, promises and related amendments or termination if landlords fail to do so, the government’s proposal defines.
“If lessors or sublessors do not notify the tax and customs authority [AT]“Elements such as renting, subletting, and changing or terminating contracts, then “tenants may make said communications,” said the proposed law for the Mais Habitação program, published on Friday evening.
These are amendments to the Stamp Duty Code, which specify that landlords and sub-landlords must report leases and subleases and related promises to the Treasury.
Appropriate changes or terminations of contracts must also be reported to AT.
According to the same code, notifications are made “by the end of the month following the start of the lease, sublease, change, termination or, in the case of a promise, the availability of the leased asset, according to an official application form,” by order of the Ministry of Finance.
More Housing legislation is under public comment until March 10.
Among the measures envisaged in this program are the provision of more land for housing construction, incentives for private construction, or tax incentives for landlords to place houses on the rental market.
The government estimates that Mais Habitação measures will cost at least €900 million.
