The Court of Appeal of the International Motorcyclist Federation (FIM) has canceled the penalty in the form of a long double lap to Spaniard Marc Marquez for an accident with Portuguese Miguel Oliveira at the MotoGP Portuguese Grand Prix.
The original sentence was handed down to Marquez (Honda) to serve his sentence at the Argentine Grand Prix, the second round of the MotoGP World Championship, just after the Portuguese trip, played on 26 March.
However, the Catalan driver has yet to compete due to an injury he sustained in a crash with Miguel Oliveira (Aprilia).
In view of Márquez’s announced absence from Argentina, the panel of commissioners corrected the original decision, indicating that the penalty should not be carried out in Argentina, but in the next race in which Márquez competed.
The Honda team did not accept the change and appealed the fine, which has been suspended since April 12.
On Tuesday, the FIM Court of Appeal considered that the punishment imposed on the Spaniard was executed “with his non-participation in the Argentine race.”
Thus, “Marc Marquez is eligible to compete in the next race in which he can compete without any further sanctions.”
The next round of the MotoGP World Championship is the French Grand Prix on Sunday.
Miguel Oliveira, who meanwhile returned to competition in Austin (USA) in the third round of the season, will miss this fifth race due to a new injury, this time to the shoulder, at the Spanish Grand Prix two weeks ago.
