Justice Minister Rita Judice said the anti-corruption measures presented by the government aim to “ensure that justice is administered and used for the right purposes” without any “delay manoeuvres”. In an interview with CMTVA government official explained the executive’s plans with 32 measures presented this Thursday at the Council of Ministers.
Describing ‘“Anti-corruption program” as a commitment, the Minister of Justice began with the fact that it is possible to confiscate assets to avoid illicit enrichment without conviction.
The creation of a mechanism for mass confiscation of assets, which may include in certain cases relief from the presumption of conviction, is one of the measures provided for by the Anti-Corruption Program.
“A citizen can lose assets, despite the fact that he was not convicted. The law already has mechanisms that allow this to be done. The crime of illicit enrichment is clearly unconstitutional. The mechanism we want to test involves taking the extended confiscation mechanism and making it more comprehensive,” explains the governor.
Answering the question about whether these measures could jeopardize the protection of citizens, Rita Judice explained that they are only trying to prevent the use of the provided mechanisms as deterrent maneuvers.
“The goal is not to reduce the guarantees of citizens, but to prevent the use of certain mechanisms that are intended as deterrent maneuvers,” he explains.
On delays in justice, the minister said it was “difficult” to find a balance between speedy justice and justice that effectively takes into account citizens’ rights.
Often, due to problems with court officials, the speed of the courts is reduced. By defining a situation as a “problem”, a government official ensures that the executive branch is taking action to respond to it. As for court officials, he says negotiations have already begun.
The governor also emphasized that he is now analyzing how hidden methods of evidence can be regulated.
“We have two and a half months of work, but we have already done a lot,” he assured.
