Platforms are required to pay journalists

The approval last Thursday by the Council of Ministers of the transposition of the directive on copyright and related rights in the digital single market plays a fundamental role in the press sector in Portugal, regulating the use of copyrighted works in the digital media environment. , namely journalistic articles.

One of the main provisions of the directive is the obligation of news aggregators such as search engines (Google) and content sharing platforms (Facebook, YouTube) to obtain permission from publishers to display news snippets. In addition, the directive encourages fair and transparent negotiations between publishers and platforms in order to guarantee rewards for the use of their content. This is especially true in an environment where online advertising plays a significant role in generating press revenue.

“This directive, which creates a new related right for press publishers, we are confident will allow them to objectively see the remuneration for use made in the digital environment, contributing to the sustainability of the sector,” says Carlos Eugenio. , executive director of Visapress, the organization responsible for the collective management of press copyright, which has long called for the directive to be moved. “By strengthening the rights of news editors and ensuring fair remuneration for the use of their work, the directive contributes to the sustainability and future of the press sector in Portugal.”

On 26 July 2021, the European Commission opened infringement proceedings against Portugal for not transposing new EU legislation.
