More than three million TikTok users in Portugal can receive compensation

TikTok is the subject of two lawsuits in Portugal brought by Ius Omnibus, an NGO founded by former MEP Ana Gomez, which is calling for the Chinese social network to be condemned for its illegal and dangerous activities. Compensation could amount to 1.12 billion euros.

However, the NGO’s main goal is to “force TikTok to fix its practices,” the lawyer says. The lawsuit has already been filed with the Lisbon Central Civil Court.

One concerns users under the age of 13 “who cannot consent to the use of their personal data, which is obviously not respected and who are at greater risk when exposed to content that manipulates and exploits feelings or encourages dangerous behavior such as well as defiance, self-mutilation and eating disorders.” For them, Ius Omnibus is seeking global compensation of up to 450 million euros.

The other, worth €670 million, includes users over 13 years old due to “misleading commercial practices” and “non-transparent privacy policies”.

On Wednesday, the association launched the TikTok.iusomnibus website, where citizens can get more information about the action and register. Ius Omnibus resorts to the so-called “popular action”, a mechanism that allows any person or entity to bring a claim in defense of society in “vague interests”, that is, those that cover the population as a whole.
