SDP asks government questions about court decisions pending enforcement by tax authorities

An PSD parliamentary group on Wednesday asked the government how many judgments are in AT services for more than 60 days pending execution following complaints of non-enforcement on this issue.

Starting with the fact that the Tax and Customs Authority is obliged to execute the decisions of the courts, the Social Democratic deputies refer to the fact that there are complaints “that the AT, despite being convicted in court, does not proceed with the execution of sentences in a timely manner, refraining from restoring the law on conditions determined by the competent judicial authorities.”

This situation, the deputies are quoted in the text of the question addressed to the Secretary of State for Taxes, means that taxpayers “are even obliged to sue for the execution of court decisions on payment of the amount to enforce the sentence and, thus, see the court decision executed.”

Whereas, in the event of “full or partial claims or administrative appeals or litigation in favor of the taxpayer”, the AT is required to “restore the situation that would have existed” if the wrongfulness had not been committed, MPs, remember that the time limit for this is 60 days.

In addition to the number of judgments that have already exceeded that time limit, the SDP parliamentary group also wants to know how many enforcement actions have been taken against AT in the past five years and how many are currently pending in the courts.

In a question addressed to Nuno Santos Félix, the PSD also asks what instructions the guardianship will give and what steps have been or will be taken by the AT “to correct situations of non-compliance or impromptu enforcement of judgments”.
