‘People should be held accountable for facts’, prosecutor says

The prosecutor takes the floor after the judge asks everyone to take stock.

“What I was trying to prove here is what the witnesses knew specifically. I have never been the one to answer the questions put to the witnesses.

The prosecutor goes on to say that “people should be held accountable for the facts.”

“As for the impact, yes. Vadim only kicks, I correct this part, ”he corrects.

Now it’s Vadim’s lawyer’s turn, and he takes the opportunity to say that Claudio’s defense was trying to “lighten the defendant’s responsibility” with “pseudo-science.”

‘They’re not the type to run away when attacked’: Claudio Coimbra’s defense devalues attacks on Fabio Guerra

The defendant’s lawyer, Claudio Coimbra, begins his speech by saying that “the greatest tragedy was the death of Fabio Guerra.”

“The prosecutor listed 20 witnesses. All those who, as he understood, were not going to confirm, he rejected them, ”the defense criticizes.

The defendant’s lawyer also discounts the attacks on Fabio Guerra: “They [ex-fuzileiros] they don’t run away when attacked.”

The defense of Claudio Coimbra continues to show the autopsy result of Fabio Guerra based on the image of the skull and questions the aggression that caused the death of the PSP agent.

“It was nice to defend Vadim. From the first day, this boy tells me the first story,” says the lawyer.

The court session is resumed with a speech by Vadim’s defense.

“There is no greater loss than human life,” he begins.

Further, Vadim’s lawyer says that the defendant should be judged only by his behavior, and not by the behavior of Claudio Coimbra. “Situations cannot be contagious,” he emphasizes.

Vadim’s defense proceeds from the fact that “the charge of infringement of physical integrity” was brought and now it is said that this is “attempted murder.”

“Vadim does not rest against the wall, but goes straight to the side of Fabio Guerra. He beats him, puts his left foot forward, behind, the hip rotates. Fabio falls to the ground, and Vadim kicks him,” describes the defense of the defendant.

“It was nice to defend Vadim. From the first day this boy tells me the first story,” says the lawyer at the end of the speech.

“He was surprised, he didn’t have the opportunity to defend himself”: PSP parents’ lawyer asks for a guilty verdict for the defendants

The parents’ lawyer Fabio Guerra demands that the defendants be convicted. “He was surprised, he didn’t have the opportunity to defend himself,” says Ricardo Serrano Vieira.

The defense continues: “There is no money to pay for the suffering these parents went through.”

Fabio Guerra’s parents’ lawyer emphasizes that the PSP agent was a “friendly person”. “He helped others. He always wanted to go to the police. It is very sad that in this particular situation, the person who was supposed to protect human life the most did not do this, ”regrets Ricardo Serrano Vieira.

Fabio Guerra’s parents’ lawyer argues that the defendants did not respect the Marines on the day of the attack.

The lawyer for Fabio Guerra’s parents, Ricardo Serrano Vieira, takes the floor and expresses his regret and feelings over the death of the PSP agent and praises the accusations of the Ministry of Public Administration.

“Those who serve in the Marine Corps have above average physical fitness. They don’t box. [arguidos] since 1995 it has been just a formality. This is wrong. But it is clear that the two defendants had knowledge of self-defense techniques,” he begins.

Ricardo Serrano Vieira continues: “The footage shows Claudio leaving. Then he hugs the guard.”

“I don’t go to a disco and I don’t hug a security guard when I leave. We need to show that there is a connection with this element,” he emphasizes.

Regarding the aggression committed by the two defendants, the parents’ lawyer Fabio Guerra has no doubts. “From the side of Vadim and Claudio, their movements are almost the same. Left foot forward, right foot back. Rotate your hip and strike,” he says. “It demonstrates their technique,” notes Ricardo Serrano Vieira.

The parents’ lawyer Fabio Guerra continues his speech and claims that the defendants did not respect the Marines on the day of the attack.

“What was expected of the Marines that night? he asks. “I was expecting someone whose mission is to protect the Portuguese, with such a high level of demand. They were waiting for a mission to go to Lithuania. They are the best, of the best, and this kind of behavior is not expected of them,” says Ricardo Serrano Vieira.

Prosecutor says former Marine cannot ‘get less than 20 years’ for Fabio Guerra’s death

The prosecutor states that Claudio should be found guilty of aggravated murder and two attempted murders.

In relation to Vadim, the prosecutor asks to recognize him guilty of committing one murder and two crimes with infliction of bodily harm.

According to the prosecutor, Claudio cannot “get less than 20 years” for Fabio Guerra’s death.

14:42 | 20.04

The prosecutor claims that the cause of Fabio Guerra’s death was injuries sustained “as a result of the actions of the two defendants.”

The prosecutor states that the cause of Fabio Guerra’s death was injuries sustained “as a result of the actions of the two defendants.”

Fabio Guerra’s parents listen to the prosecutor in tears.

14:19 | 20.04

The prosecutor says the defendants knew that a kick while Fabio Guerra was lying on the ground could “lead to death.”

Prosecutor Luis Lourenço begins by expecting the impartiality of the jury.

“He who does not feel is not the son of good people,” he emphasizes.

The prosecutor continues and says that after watching the video, they corrected some parts of the defendants’ testimony.

“We should take into account the witnesses presented by the prosecutor’s office, who seemed credible to us,” he says.

The prosecutor continues: “The rest of the evidence must be taken into account, namely, expert examinations, documentation, video recordings.”

“There is an excessive reaction from Vadim. [Cláudio Pereira] fell lifelessly to the ground,” the prosecutor says.

“They knew that by kicking they could kill [a Fábio Guerra]”, he further mentions.

Luis Lourenzo moves forward and says that the brutality of the attacks “was visible in the images”.

“With every blow from Claudio, a person loses consciousness. We see this with Claudio Pereira and Fabio Guerra,” the prosecutor emphasizes.

Suspend session. Trial over the death of PSP agent Fabio Guerra resumes at 2:00 p.m. with final charges.

10:28 | 20.04

The prosecutor wanted to include a CMTV report on the training of former Marines in the process.

The defendants testified in court that they completed only 4 or 5 self-defense classes, but a CMTV report that accompanied the Marines showed intensive training.

The prosecutor wants the report in question to be evaluated and included in the case, but the judge refuses this, not considering the report as evidence.

The court also refused to hear a medical examiner requested by the defense in an attempt to rule out the crime of murder and defend the hypothesis of a crime of bodily harm. The thesis that the victim died of an aneurysm will have to be defended by the defense of the accused in the final charges.

Cabo Fonseca contradicts himself over how he knew the encounters were with PSP agents

Corporal Fonseca goes on and mentions that the ex-Marines told him they were attacked at the disco door due to a mix-up with PSP agents.

“They told me that the story they told was true,” he adds.

“I didn’t see any images when I spoke to them,” he stressed.

The defense asks, “Was Claudio a normal soldier? Have you ever had problems?

“In particular, with Claudio, we completed the mission together in 2021. He met the standards. He has always been obedient. He always did what was required. Never had any problems,” corporal Fonseca replies.

An eyewitness reports that when they learned of Fabio Guerra’s death, “psychology services were called.”

“We were devastated when we learned about the death,” he continues.

When the judge asks him how he knew the PSP agents were involved in the confusion, Corporal Fonseca contradicts himself.

“I heard about it from the media,” he eventually states.

The judge insists, “Did they already know when they called, or did the cable say they were a PSP?”

“They reported a fight and the hospitalization of one of the militants,” says Corporal Fonseca.

“They already knew it was a PSP,” the witness continues.

The witness has been fired.

Corporal Fonseca: “I tried to find out if [Cláudio] was one of the aggressors

The court session begins with Corporal Fonseca being heard through a video call on his cell phone. He is in Mozambique, participating in the fighting.

Corporal Fonseca knows the defendants from the Marine Corps rate and the base where they were stationed.

Claudio Coimbra’s defense asks: “Can you report the first contact you had? How did you find out about the facts?

Corporal Fonseca replies: “It was lunchtime and Claudio Coimbra called me. He said he made a mess outside the disco. [do que tinha acontecido]”.

“He told me that one of the elements involved was hospitalized,” he says.

“I tried to find out [Cláudio] was one of the attackers. I immediately told him that in connection with this we should contact the structure, ”he says.
