Donald Trump has demanded a mistrial in a civil lawsuit in which writer E. Jean Carroll accuses him of rape and defamation, according to a letter from the former US president, Reuters reports. The former US president claims that the judge made several “unfair and harmful” decisions against him.
In an 18-page letter filed Monday in Manhattan federal court, Trump’s lawyer Joe Tacopina accused U.S. District Judge Lewis Kaplan of bias against the former U.S. president, including in front of a jury.
He said the impact of Kaplan’s decisions “shows a deeper bias towards one side compared to the other”, including in comments where the judge “openly expresses favoritism”.
Lawyers for Carroll did not immediately respond to Reuters requests for comment. The trial is expected to resume on Monday, with Carroll facing a second day of cross-examination of Tacopina.
Mistrial motions are often difficult to obtain, even if they are based on the judge’s own statements. These requests are also often the basis for possible appeals.
Carroll, 79, accused Trump, 76, of raping her in the locker room of Bergdorf Goodman in late 1995 or early 1996 and then undermined her credibility and career by lying about it online.
The former Elle columnist’s defamation lawsuit concerns an October 2022 posting on Trump’s Truth Social platform in which he called the Carroll case a “complete scam”, a “hoax and a lie”.
Trump has consistently denied that the violation ever took place.
