The Liberal Initiative (IL) will ask the Commission on Constitutional Affairs to appoint a rapporteur to prepare an opinion on the need to dismiss members of the “secrets” supervisory board.
IL will send a request today to the President of the Committee on Constitutional Affairs, Rights, Freedoms and Safeguards (Fernando Negrao, from PSD) following a debate in this morning’s meeting of that committee on whether the CFSIRP dismissal process was already in place or was not launched after the request was approved by the Liberals and the subsequent CFSIRP Members’ Hearing, which took place in Parliament on Wednesday behind closed doors.
PSD and IL argued that the process had already been initiated because the steps required by law had been followed without appointing a rapporteur to provide an opinion, while PS and Chega believed that this was not the case.
The acting president, socialist Claudia Santos, indicated that the commission’s services had the same negative connotation, arguing that IL did not express its intention to proceed with the process of firing CFSIRP members after the hearing and did not request the appointment of a spokesperson.
The 1984 SIRP Framework Law establishes that “The Assembly of the Republic shall be responsible for reviewing impediments, as well as for deciding on dismissal, after an opinion issued by the competent committee on constitutional matters, rights, freedoms and guarantees after hearing the case.” member, by a two-thirds majority of the deputies present, not inferior to the absolute majority of deputies in terms of their current functions.
Now IL is asking to appoint a rapporteur and make an opinion on whether the three members elected by the Assembly of the Republic should be dismissed, to be “discussed and voted on in the plenary” later.
In a document that Lusa had access to, I.L. also points out that the “procedure for dismissal of CFSIRP members is unprecedented” and “insufficiently detailed” in the SIRP Framework Law, but argues that “to complete the resignation procedure” a “post-judgmental opinion” of the 1st Commission is “clearly necessary”.
The Liberals indicate that the request for a hearing of CFSIRP members was submitted “for the purpose of initiating dismissal proceedings” and that it is their understanding that the proceedings were initiated by that hearing.
At today’s meeting of the Committee on Constitutional Affairs, Rights, Freedoms and Guarantees, Congresswoman Patricia Gilvaz stated that “I.L. was asked whether the appointment of a rapporteur and the dismissal of the Supervisory Board should be abandoned.”
“IL has never made it clear that it has abandoned the resignation process,” he said, referring to the expression that the party was not satisfied with the clarifications provided and that in this sense “the process should be maintained.” .

The panel today denied Chega’s request to start the CFSIRP termination process with PS, PSD and PCP voting no, IL abstaining and Chega voting yes.
