The Ministry of Justice’s clarification comes after the Automóvel Clube de Portugal (ACP) appealed to the Assembly of the Republic to vote against the government’s decision to pardon young people under the age of 30 who have committed traffic offenses such as drunk driving.
The Ministry of Justice cites that “contrary to the message circulated by the ACP”, the government’s bill establishing the waiver of sentences and amnesty for offenses committed by young people between the ages of 16 and 30 “contains significant restrictions on its application. “, with many exceptions for which “neither pardon nor amnesty” applies.
According to the Ministry of Justice, persons convicted of dangerous driving of a road vehicle and driving a vehicle under the influence of alcohol or under the influence of narcotic drugs or psychotropic substances are not subject to pardon and amnesty, and in relation to offenses – those committed in a state of alcoholic or narcotic intoxication.
Last week, the Council of Ministers approved a charter establishing pardons and amnesties for crimes and offenses committed by young people between the ages of 16 and 30, in connection with the visit of the Pope to Portugal on the occasion of World Youth Day, which takes place in the first week of August.
The diploma, which will be reviewed by the Assembly of the Republic, defines a one-year pardon for all sentences up to eight years in prison, and establishes an amnesty regime that includes administrative offenses, the maximum applicable fine limit for which does not exceed 1000 euros and criminal offenses, punishment for which does not exceed one year of imprisonment or a fine of 120 days.
The government’s bill also includes other exceptions to the rules of pardon and amnesty that do not include, among others, those who have committed crimes such as murder, infanticide, domestic violence, abuse, serious violation of physical integrity, female genital mutilation, insult to qualified physical integrity, coercion. marriage, kidnapping, against freedom and sexual self-determination, extortion, discrimination and incitement to hatred and violence, influence peddling, money laundering or corruption.
