The preliminary CPI report for TAP was submitted to Parliament on Tuesday. The 180-page document, written by Socialist MP Ana Paula Bernardo, was delivered around midnight.
The report, which mentions little about Federico Pinheiro, says that the Treasury Department will not be aware of the compensation and clears the blame from the government.
There is no evidence that the Ministry of Finance knew about the compensation
The preliminary report of the TAP Commission of Inquiry concluded that there was no evidence that the Treasury Department was aware of the process of leaving Alexandra Reis, which I only became aware of at the time of the publication of the statement in CMVM.
“CPI found that there was no evidence that TAP’s shareholder, the Ministry of Finance, was aware of Alexandra Reis’ departure process, without any communication from TAP, namely the PCA. [presidente do Conselho de Administração] or financial director [administrador financeiro] as the main interlocutors with this tutelage, nor through the IIR [Ministério das Infraestruturas e da Habitação]nor Alexandra Reis herself,” reads a preliminary report drawn up by socialist MP Ana Paula Bernardo, which was handed over to the committee tonight.
No connection was found between the departure of Alexandra Reis from the company and the transition to NAV.
“There is no evidence of any link between TAP’s departure and the invitation and corresponding appointment to NAV,” the report said.
According to the speaker, “all statements on this subject, such as [do ex-secretário de Estado das Infraestruturas] Hugo Mendes, [a ex-presidente executiva da TAP] Christine Urmier-Widener herself and Alexandra Reis point to the lack of information about such a possibility during the TAP resignation process.”
“The profile, solid skills and deep knowledge of the industry on the part of Alexandra Reis were the reasons given by the then rulers for this choice,” says the document on Alexandra Reis’s departure from the TAP administration and appointment to the presidency. NAV Portugal – Air Navigation shortly thereafter.
The deputy rapporteur wanted to avoid “contaminating” the report with the Federico Pinheiro case.
Federico Pinheiro’s name is mentioned only once in the preliminary report of the TAP commission of inquiry, which was justified by the socialist deputy rapporteur in order to avoid “contamination” by situations that are not related to the topic of the works.
In the document prepared by Ana Paulo Bernardo, Federico Pinheiro’s name is mentioned only in the column with the list of hearings, where it is mentioned that he was heard “as a former Assistant Minister of Infrastructure, accompanied by a lawyer, Dr. Piero”. Joao Nabais.
In the introduction to this document, a total of 180 pages, the Deputy Rapporteur justifies the possibility of not analyzing the incidents that occurred on the premises of the Ministry of Infrastructure with Frederico Pinheiro, as well as the use of information services by the government to restore the computer taken by former Assistant Minister Joao Galamba.
“This is a TAP report. It is not intended to be used as a CPI (Parliamentary Commission of Inquiry) diary. This is a report on the management of the company and the management of TAP’s political custody,” he says.
Commitment to pay 55 million to Neelman is not consensual
The preliminary report of the TAP investigation panel indicates that the €55 million paid to former shareholder David Nieleman for leaving the company was the result of negotiations, although there was no consensus on the obligation to pay them.
“The amount reached is the result of negotiations to the point of mutual understanding between the parties. However, the existence of a payment obligation to David Neeleman was not generally recognized, especially in the context of some legal uncertainty regarding the terms under which the privatization was carried out in 2015 with the abandonment of the Airbus Funds mechanism, the document says.
Following the covid-19 pandemic and the difficulties TAP faced in 2020, the government was left with a choice of either nationalizing the company or entering into an agreement with private shareholders, the report said.
The government should improve the classification of documents and coordination between guardianship authorities.
The government should improve the document classification process and the harmonization of financial and sectoral custody, the recommendations of the preliminary report of the parliamentary commission of inquiry on the administration of the TAP said.
This 180-page preliminary report was prepared by PS MP Ana Paula Bernardo and presented on Tuesday around midnight.
At the end of the document, the deputy rapporteur lists a number of recommendations addressed to companies, the Government, as well as on the work of parliamentary commissions of inquiry.
One of the six recommendations addressed to the government is to “improve document classification processes (and by extension record management processes) to ensure that records are properly classified, processed within and between government agencies and companies with the correct classification and , if necessary, with the necessary guarantees for the security of documents.
The report, prepared by Socialist MP Ana Paula Bernardo, also explicitly mentions the relationship between the guardianship authorities, in this case the ministries of finance and infrastructure and housing, in the management of public companies.
“In the exercise of the shareholder/manager stewardship function, ensure that the balance between financial and industry stewardship is improved by ensuring that the division and interrelationship of responsibilities are clear and intended to serve the public interest; this improvement should be reflected precisely in the definition of guidelines and goals (including the evaluation of the effectiveness of their implementation), as well as in the proposal, appointment and dismissal of members of corporate or statutory bodies, ”the document says.
New TdC audit to include information on Airbus funds
The TAP Investigation Board found that the list of documents from the Court of Accounts (TdC) received by Parpública for a previous audit did not contain references to Airbus facilities, additional information that will be included in the new audit.
“CPI found that the list of evidence presented by the Court of Accounts differs from the list of documents that Parpública indicated as sent to the court, since the list of the court does not contain references to “Airbus funds,” the report says. report.
We are talking about the capitalization of TAP in the amount of 226.75 million euros by Atlantic Gateway – a consortium formed by David Nieleman and Humberto Pedrosa – as part of the privatization carried out at the last stage of the PSD / CDS-PP government led by Pedro. Passos Coelho. “With regard to the capitalization process and its relationship with Airbus, the Accounts Chamber considered the following information to be relevant, so it will include it in the already announced new audit,” the report says.
