Municipalities can’t veto a new airport

The “overwhelming majority” that “allowed, by voting in favor or abstention, the new legal regime” justified the decision of the President of the Republic to implement “a diploma of the Assembly of the Republic clarifying the intervention of municipalities in the procedures for the construction, expansion or modification of national civil airfields,” according to a note released on Monday by the presidential administration.

The Diploma, created from a government bill, was approved in a final global vote on June 2, voting PS and Chega, abstaining from PSD and the Liberal Initiative, and voting against PCP and Bloco de Esquerda. This was a preliminary assessment of the viability of procedures for the construction, expansion or modification of airfields. According to the government, the law should make it clear that the opinion of city councils “has only legal significance” regarding “the potential impact on the municipality of building restrictions to guarantee unobstructed surfaces and for environmental reasons.”

The problem arose in 2020, when it was determined that with current legislation and a categorical refusal by two environmentally disadvantaged city councils to give approval to the project, the National Civil Aviation Authority (ANAC) would not be able to obtain a license for the new Montijo airport. At the time, the then Minister of Infrastructure, Pedro Nuno Santos, stated that the law needed to be changed because “the mayor of Moita should not decide for the country, for the region of Lisbon and, by the way, if we want to get closer, for Alcochete, Barreiro and Montijo.”
