The Constitutional Court (CC) considered this Monday the decision on the Single Contact Center for International Police Cooperation after the President of the Republic demanded a preventive verification of the diploma.
President of the Constitutional Court João Kaupers told a press conference at the TC headquarters in Lisbon that after analyzing the two norms in question, he decided “not to express his opinion on unconstitutionality”.
It will be about the separation of powers after several parties that won seats in parliament accused the government of trying to control the state apparatus, making Interpol and Europol dependent on the government.
The President of the Republic, Marcelo Rebelo de Sousa, demanded a preventive review of the decree, “bearing in mind that it is a question of fundamental rights, which caused a split in Parliament for political and constitutional reasons” and “in order to ensure the rule of law”.
Based on a government proposal, the decree that restructures the Single Contact Point for international police cooperation was approved in the Assembly of the Republic in a final global vote on October 27, with votes for PS and votes against all other parties: SDP, Chega, Liberal Initiative, PKP , BE, PAN and Livre.
