The services and bodies under the Ministry of Economy and the Sea have three months to publish an online prevention plan, a code of conduct, a training program and an information channel aimed at combating corruption.
According to Decree No. 8680/2023, published this Monday in Diário da República, the goal is to “put into practice in the field of economy and the sea” “the tools and tools necessary to prevent and combat corruption and fraud” provided by the existing regulatory framework as part of the National Anti-Corruption Strategy for 2020-2024.
According to the terms of the diploma published this Monday, all services and bodies supervised by the Ministry of Economy and the Sea, including mission structures under its direction or control, will have to adopt and implement a plan to prevent corruption risks related to delinquency and conflicts of interest (PPR) , as well as a code of conduct, a training program and a communication channel.
All of these documents “must be published on the website of the service or body to which they refer within a maximum of three months.”
In addition, the order determines that the services under the supervision of the Ministry of António Costa Silva must “adopt a “checklist” for combating collusion in public procurement”, attached to the diploma, “prepared in accordance with the recommendations of the Competition Authority” and that “ must accompany as an attachment the award proposals submitted by the Jury or, otherwise, by those who review the proposals.”
In order to guarantee and control the application of the various instruments provided for in the order, the entities in question must appoint a responsible person “from among the senior management or equivalent”.
Services and bodies of the Ministry of Economy and the Sea with less than 50 employees will be supported by the General Secretariat of the Ministry in the preparation and implementation of the diploma and must report to this service by March 15 of each year a report on the monitoring and application of various tools.
By the end of April each year, the general secretariat of the ministry must submit a report on monitoring and application of the order with recommendations for approval by the supervising minister, which must be published on the website of various services and bodies. .
