The trial of a woman and a man will begin on November 16 in Vila Real for a crime that caused grievous harm to their son, who was four months old when he was hospitalized.
The two defendants, who live in Chavez, will be tried by the panel of judges of the Vila Real court and accused by the Office of the Public Prosecutor (MP) of being a co-author of a crime causing grievous bodily harm, in an apparent struggle, with one case of aggravated domestic violence.
The facts, according to the deputy, relate to the behavior of the defendants towards their son, who is now about one and a half years old.
In the summer of 2022, the child was admitted to hospitals in São João, Porto and Chavez with a poor prognosis after he was diagnosed with very serious injuries consistent with shaken baby syndrome.
Suspicions of parental abuse led to an investigation by the Vila Real Judicial Police.
When the charges were announced in May, the deputy also said that “measures must be taken against the man to challenge paternity.”
According to the indictment brought by prosecutors, between at least July 21 and August 4, 2022, “the defendants repeatedly and vigorously shook the body of their infant son, impressing him with sudden, violent and consistent movements.”
The deputy stated that the motives “have not been specifically established”, that the defendants “acted individually or jointly, but always with the tacit consent of both and in concert, repeatedly, on dates and dates not specifically established, but nevertheless twice.”
With this behavior, according to the deputy, “the defendants caused the child’s retinal hemorrhages and subdural hemorrhages, small foci of subarachnoid hemorrhages and multiple convulsive crises.”
Which, he added, represented “a situation of real danger for the victim” and led to his hospitalization in the pediatric intensive care unit due to “mild to moderate diffuse encephalopathy, subarachnoid hemorrhages, subdural hematoma and hemorrhages in the fundus.”
The prosecutor’s office also asked for compensation to be awarded in favor of the victim at the expense of the accused.
The defendants are awaiting trial under a coercive measure prohibiting them from contacting or approaching the child by any means and in any place, directly or through an intermediary.
