Portugal has two months to report to Brussels on measures taken in the context of railway safety, under threat of referring the case to the Court of Justice of the European Union.
This Thursday, the European Commission sent a reasoned opinion – the second stage of the infringement process – giving Portugal two months to respond to the identification of gaps in the “oversight of the safety management systems of railway companies and infrastructure managers, as well as the organizational capacity of the Portuguese national security authorities.”
The Rail Safety Directive requires member states to establish national safety authorities responsible for overseeing and enforcing the railway safety system.
Member States must also ensure that the national security authority has the necessary internal and external organizational capacity in terms of human and material resources.
