The United Nations Convention on the Rights of Persons with Disabilities (Me-CRPD) Monitoring Mechanism accused the government this Friday of a “lack of quality, rigor and capacity” in regulating the Independent Living Support Model.
The body said in a statement that the government had not given the Me-CDPD the “necessary time” to comment on the regulation setting out the conditions for the creation, installation, organization and operation that this social response must comply with, limiting itself to observing the legal formality of consulting the Me-CRPD.
The mechanism emphasized that it was given only 24 hours to issue an opinion, which, although mandatory, is not binding, which, Me-CDPD charges, involves “mere concern for the fulfillment of the obligation without taking into account the time required to verify compliance ” with the principles and standards of the Convention and the formulation of recommendations.
“We therefore believe that the regulation of critical social services for people with disabilities has lacked quality, rigor and opportunity, which is undesirable for Me-CRPD members,” the text reads.
Emphasizing that “the right to independent living and participation in society is also a right of people with disabilities,” the movement said that “by acting in this way, the government has not given the Me-CDPD the opportunity to make a serious and full statement.” this normative initiative, as it would be its responsibility.”
The Me-CDPD further stated that “none of the recommendations of the Me-CDPD were adopted in this final version of the Regulation, recommendations which were aimed at achieving greater compliance with the spirit and provisions of the Convention where the right to independent life and participation in life of society.”
The government announced on Thursday that from January 2024, around 3,000 people with disabilities or disabilities should benefit from a new personal assistance service from social security.

The decree establishing the conditions for the creation, implementation, organization and operation of this new social response was published on Thursday in the Diário da República.
