Landlords with pre-1990 income will be able to apply for compensation to the IHRU (Institute of Housing and Urban Rehabilitation) from July 2024, the Department of Housing said.
The information appeared after the President of the Republic, Marcelo Rebelo de Sousa, published a diploma allowing him to receive this compensation.
In the Mais Habitação program, “it was decided to create a compensation mechanism that would be distributed to landlords and, for this purpose, the government requested an independent study to support the best solution.”
Thus, in the now promulgated Decree-Law, “it was decided to maintain the cost of rent and introduce compensation to lessors within 1/15 of the value of the tenant’s tax asset (VPT).
According to the manager, “this compensation corresponds to the difference between the amount of accrued monthly income and this limit, and there are no personal income taxes or social security contributions on it.”
Thus, as the diploma emphasizes, “without prejudice to the updating of the rent value in accordance with the inflation rate in 2024, starting from July of the same year, landlords will be able to submit a corresponding request for compensation to the IHRU, IP.” .
“This diploma represents the culmination of the government’s work to find a structural solution that ensures a fair and balanced solution for tenants and landlords,” the same release said.
The government recalled that the Mais Habitação program sought to “guarantee the safety of tenants by not transitioning to the new urban rental regime of these contracts, in particular by continuing to protect tenants aged 65 years or older, with a proven disability or in a situation of economic need”, as well as to “compensate landlords through the IMI and IRS tax exemptions for these contracts already provided for in the 2024 state budget.”
The goal is to “bring stability and predictability to these leases, allowing rents to be renewed on the same terms as other contracts.”
