Chairman of the Transparency Commission says PS MP should not refund funds The MP indicated that in case of an incompatibility situation, the consequence is to notify the MP concerned.

The chairman of the Commission on Transparency and the Status of Deputies said on Tuesday that the law does not provide for substitution of funds in cases such as the case of Socialist MP Jamila Madeira, who accumulated her mandate with functions in the REN.

“The law does not provide for the replenishment of funds as a result of this situation. Either the person corrects, or if not corrected, the mandate is lost, the replenishment situation is not even provided for in the law,” said Alexandra Leitao, also from PS.

Speaking to reporters at the end of the Transparency Commission meeting on Tuesday, the MP indicated that “in accordance with the provisions of the Statute of Deputies, in particular Article 21.ºB of the Statute of Deputies, when a situation of incompatibility arises, the consequence is to notify the relevant MP so that he could put an end to the situation of incompatibility within 30 days.”

“And only if the deputy does not comply with this, so that the situation stops, then there may be a loss of the mandate. That is, the consequence of the commission’s review of the situation of incompatibility is a notice of termination,” he said.

“From the moment the lady in question informs us that from January 1, 2023, she will be exceptional, that is, only here in Parliament, in fact, even if the opinion was subsequently approved, there was no other. consequences, because the consequence would be to notify her of the termination of the situation, of which she has already informed us that “motu proprio” [de livre vontade] I was going to do it,” the chairman of the commission defended.

Confirming that the return of funds “is not considered as a legal consequence” in such situations, Alexandra Leitao said that “it is envisaged to end the situation.”

“In this case, the situation has already stopped,” he stressed, arguing that for this reason the commission considered “unanimously, now on January 10” that “there was no point in approving the conclusion, because what has been done is what has already been done” .

When asked if the matter was closed, Alexandra Leitao was adamant: “From the side of the Transparency Commission, with the data we have today, yes.”

Regarding the postponement of the vote on the draft conclusion on December 20, Alexandra Leitao indicated that the issue was raised “initially by the PS parliamentary group”, but the decision to postpone was made “by agreement in the committee”.

“In this case, there was even a supervent that arrived shortly before, which was an additional document justifying further analysis,” he added.

In a statement released this afternoon, the Transparency Commission explained that the process of investigating the impeachment of MP Jamila Madeira was completed on January 10, since the parliamentarian has been exclusively in Parliament since January 1.

Last July, the socialist asked for an opinion on her statement of interest registration, taking into account her employment relationship with REN Serviços, SA, and the commission drafted an opinion, which pointed out “an obstacle to the cumulative exercise by Ms. Jamila Madeira of the Deputy mandate with the implementation functions in REN — Rede Eléctrica Nacional, SA and REN Serviços, SA”, but the document was not put to a vote.

The draft conclusion was planned to be discussed and voted at the meeting on December 20, but it was postponed because the discussion and voting did not take place.

A few days later, on December 31, Jamila Madeira informed the commission that from January 1, 2023, this would be on an exceptional basis, and already on January 6, she asked the commission if she could refuse to issue the opinion she had originally requested, since the reason for the request had disappeared .

Last week, the Committee on Transparency and the Statute of Deputies debated a “unanimously waived opinion” on the impeachment situation against the vice president of the PS parliamentary group for “subsequent uselessness” as the deputy already has exceptional functions as of the 1st of this month.
