The Constitutional Court (CC) accepted on Tuesday an application for registration of the political party Nova Direita, led by Ossanda Liber, after rejecting the application three times due to irregularities in the process.
According to the TC ruling dated Tuesday, which Luza had access to, the judges of Palacio Ratton decided to “grant the request for registration in the Constitutional Court’s own registry of a political party called “NOVA DIREITA.” have the abbreviation ND.
By a resolution dated December 13, the Labor Committee rejected the party’s request for official registration for the third time, considering that the draft charter did not comply with legal requirements.
This year, the movement under the chairmanship of Ossanda Lieber (who was vice-president of the Alliance party) had already requested registration as a party twice, but the TC then rejected it due to a lack of subscribers (minimum 7,500 signatures) or due to the discovery of invalid signatures.
According to the judges, the last time they rejected the petition, “legality objections were formulated that led to the refusal to register the ND party in the court’s own registry, as well as recommendations related to such objections.”
“At the moment, only objections regarding legality are relevant, and not recommendations (which do not inherently prevent any political party from registering on the register),” they explained in Tuesday’s ruling.
Thus, the TC decided that the draft charter and declaration of principles presented by the movement “do not raise any issues of legality that could justify the refusal to register the ND party,” explaining that no new violations arose, and those that existed were eliminated. it was decided.
When news of the third refusal of the Constitutional Court became known, the president of Nova Dirate announced through social networks that the movement had submitted a new charter to the Constitutional Court “in the hope that the situation” will be resolved in time “to participate in the legislative elections on March 10.”
Ossanda Lieber also considered the TC’s decision to represent “a significant setback for the New Direita, which seeks to present a new political vision and defend the conservative values and principles that it considers important for the country.”
“Nova Direita believes that this refusal is a form of discrimination that limits the party’s ability to engage in political debate and represent its constituents,” criticized the movement’s leader, accusing judges at Rutton Palace of discrimination. “in the way the process was carried out and in the arguments given, which were never required of any political party in Portugal.”
