Speaking to Lusa, IL Deputy and President Rui Rocha detailed the general features of the bill, explaining that “there are certain conditions that involve frequent but occasional disability.”
“And because they are frequent but intermittent, usually of short duration, they end up having consequences for people suffering from these conditions who don’t have access to paid sick leave,” he said, because “in the normal system, sick leave is sickness, the first three days are not paid.
For Rui Rocha, the creation of intermittent and intermittent disability certificates is “a matter of social sensitivity because these people can suffer a very punitive effect on their remuneration and do not have any protection because the Social Security sick leave system is accurately predicted for different episodes “.
“And if a person has ten such episodes during the year, then he loses 20, 30 days of salary, because the Social Security sick leave system is not provided for such conditions,” he explained.
The bill, according to the Liberal, follows a petition to be debated in Parliament on Feb. 16 to create a National Strategy to Combat Endometriosis and Adenomyosis, “although it doesn’t just address endometriosis itself” but other conditions as well. “having this profile of intermittent and frequent disability”, such as Crohn’s disease or multiple sclerosis.
“We envision two mechanisms: a general one that says a person is suffering from this condition and so if they have specific episodes they can take advantage of this Social Security loss protection with a different regime, but then there is always a need for a specific medical certificate relating to specific episodes,” he specified, while the government is expected to adjust this law within 180 days.
According to Rui Rocha, then “the general regime would have been applied”, because “the only difference is that what is called the waiting period of three days, in this case, would not occur for every episode, but only for the first”. and from that moment on, the dismissal is always rewarded from the first day.
In addition to this initiative, IL has also tacked on to this petition a draft regulation – without the force of law – “more health, diagnostic and SNS oriented” on access to diagnosis and treatment of endometriosis and adenomyosis. .
“We expect both to be approved. We have no guarantees because we have not previously discussed this with either side,” he said.
This bill will be one of the last in Rui Rocha’s area of responsibility when he was an effective member of the parliamentary committee on labor, social security and integration, since after the necessary restructuring after winning the IL leadership, he no longer serves on committees. as happened to his predecessor João Cotrim Figueiredo.
“This is actually something that I have made mandatory for promotion and presentation because this is what we have been preparing for some time. We realized that it would make more sense to introduce him when the petition was discussed. seems quite fair and right,” he said.
