The Leadership Conference discussed this Wednesday the composition of the parliamentary commission of inquiry proposed by BE on TAP, which is “under analysis”, but the only MPs PAN and Livre disputed the possible exception.
According to the leader’s conference spokeswoman, socialist Maria da Luz Rocinha, Parliament President Augusto Santos Silva asked deputies to “name names” who will form this commission of inquiry, adding that there is still no date for taking office.
“There is an offer on the table, in accordance with what is provided by law. The proposal is under consideration by the deputies,” the press secretary answered the question of journalists.
Moments later, the sole MPs of PAN and Livre criticized their exclusion from this commission of inquiry, challenging the majority conference’s interpretation of the law.
“The law says that the composition should be up to a maximum of 17 deputies – the law does not limit, and we do not make such an interpretation, parliamentary groups. the possibility of one MP submitting a proposal to establish a commission of inquiry, the interpretation of the leaders’ conference that only if Livre or PAN were supporters of a parliamentary commission of inquiry would they be able to integrate it, does not make sense to us,” the press said. The deputy hopes that the conference of leaders will “think over the considerations” left by individual deputies, and will be able to “go back” when voting on the composition proposal.
Regarding Livre, Ruy Tavares emphasized that “in the past there was already a commission of inquiry, of which the Liberal Initiative was a part, at that time with one deputy [João Cotrim de Figueiredo]”.
“There was no allegation that this commission was illegal (…) and therefore the law serves as the basis for what the conference of leaders decides and whether it has the political will or not,” he defended, blaming others forces with parliamentary groups of “hypocrisy” when they criticize the “skating rink” of the PS, but “are not averse to using it” against individual deputies.
According to the Legal Regime of Parliamentary Inquiries, “when determining the number of members of the commission, the maximum limit of 17 deputies must be respected, respecting the principle of representativeness provided for in Article 31, paragraph 1, of the Rules. [da Assembleia da República]”.
On 3 February, the BE’s proposal to set up a commission of inquiry to oversee the political management of the TAP was approved in parliament, with the PS and PCP abstaining and the rest of the parties voting in favor.
The text, approved without votes against, establishes a parliamentary commission of inquiry “under the political control of the TAP leadership”, which, in particular, between 2020 and 2022 will focus on investigating the entry and exit of the former ruler Alexandra Reis and guardianship responsibilities in the decisions taken.
PS has already announced that it will appoint deputy Jorge Seguro Sánchez as chairman of the parliamentary commission of inquiry on TAP proposed by BE, despite arguing that this presidency should be before Chega.
After the leaders’ conference on 18 January, it appeared that there was a tie between Chega and PS, in accordance with de Hondt’s usual method of allocating parliamentary committee chairmen.
