The President’s Minister assured on Thursday that the government does not have “in law” any initiative regarding medically assisted death, after the Ministry of Health said the regulation was “under development”.
“The government has not passed any laws, it has no legislative initiative regarding medically assisted death,” said António Leitão Amaro at the end of the Council of Ministers meeting.
On August 8, in response to a question from PS, the Ministry of Health clarified that the regulation of the law on euthanasia “is currently in the development stage.”
Asked whether he denied this official response, the minister replied that “the statements do not contradict each other.”
“I talked about what legislative intervention is. The legislative process has a sequence, and as for the approval of laws and regulations by the Government, the Council of Ministers, this is not just a discussion in the Council of Ministers, but a process that begins with the submission to the legislative process, namely with the process of “smart law”, during which diplomas circulate among various ministries, each analyzes, expresses its opinion, and then the diplomas are submitted to a meeting of state secretaries and after going through a meeting of state secretaries, they are delivered to the Council of Ministers,” he explained.
According to the Minister of the Presidency, “it does not even exist in the IT system of the government’s legislative process, [que] includes regulations and decree-laws, therefore regulations, discussions, normative decrees, decree-laws, in “smart legislation”, at a meeting of state secretaries, at a meeting of the Council there is no diploma or draft diploma on the medical death of ministers provided assistance.”
The CDS-PP, the party that is part of the government following the coalition agreement signed with the PSD in the last legislative elections, asked the Minister of Parliamentary Affairs this Thursday whether the executive branch had changed its position pending the decision of the Constitutional Court before proceeding to regulate the law.
A source in the party leadership told Lusa that “the SDS believes it knows that the news about regulating euthanasia is not true and must be the result of a failure in communication,” noting that “the government’s position was clear.” As for waiting for the position of the Constitutional Court.”
