The Constitutional Court “failed” the new SDP charter and demands that four violations be corrected

The Constitutional Court (CC) rejected the new SDP charter, approved on November 25 last year, and requires the party to correct four violations.

In a ruling dated August 8, published on the TC website, the judges decided to “reject the request to amend the Statute of the Social Democratic Party, approved at the 41st National Congress held on November 25, 2023.”

The TC asks the SDP to correct four violations, two of which involve the application of internal sanctions, namely because the new laws defer the classification of some violations to a later ruling.

“The applicant must eliminate the four currently proven illegal acts, which is a prerequisite for the registration of the new version of the Statute in the existing register of the Constitutional Court,” the Court states.

The SDP has an electoral congress scheduled for September 21 and 22, but there are no legislative discussions on the agenda.

The regulations published on the party’s website expect that the first point of the main meeting, which will take place in Braga, will be the “approval of amendments to the statute”, with the vote and announcement of the results after the opening of the work and the intervention of the PSD president.

In a conversation with Lusa, the general secretary of the PSD, Hugo Soares, refused to comment on the TC’s decision.

Direct elections for the President of the National Political Commission of the PSD were scheduled by the National Council from the beginning of July to September 6, in accordance with the rules of the current Statute.
