The Constitutional Court issued a judgment

A law amending the regulations of professional associations has been “adopted” by the Constitutional Court (CC). After the President of the Republic demanded a preventive review, due to doubts “regarding the observance of such principles as equality and proportionality, guarantees for the exercise of certain rights, self-regulation and the democratic nature of professional associations”, the TC judge considers that “any constitutional principles or norms” were not violated, Joao Kaupers, president of the CU, said on Monday. Marcelo Rebelo de Sousa has already guaranteed that he will release the diploma “immediately” after receiving the message from TC.

Among the changes made by the Diploma, approved by the votes for PS, Iniciativa Liberal and PAN, the votes against PSD, Chega and PCP and the abstentions of BE and Livre, is the restriction on the maximum duration of the internship (12 months, which can be increased to 18 in justified cases) and paid professional internships. The final evaluation of the internship will be carried out by an independent jury, which must include persons not belonging to the respective order, and a disciplinary body will be established, which must include persons not belonging to the relevant order (more information on page 39).

In Portugal, there are 20 professional orders that regulate the activities of more than 430 thousand professionals. The most recent are the Order of Physiotherapists and the Order of Social Helpers.

“wrong” law
Antonio Mendonsa, president of the National Council of Professional Orders (CNOP), believes that the law, being constitutional, “does not mean that it is not inappropriate” because it limits the “democratic functioning” of the orders. CNOP meets this Wednesday.
