The law on euthanasia is back in the hands of the President of the Republic

“If there are doubts about constitutionality, I raise them before the Constitutional Court (CC); if there is a political reserve, I return it to parliament; if there is neither one nor the other, I will accept it, ”the president of the republic said this Friday after the approval in parliament of a new text that will frame euthanasia.

Marcelo Rebelo de Souza’s reaction came during a visit to the projects of the Recovery and Resilience Plan in the company of Prime Minister António Costa, with whom he stressed that he wants to be a “positive catalyst” in the application of the European ‘bazooka’.

As for the fourth version of the medical death text, after Marcelo’s veto and two unconstitutionality objections from the Ratton Palace judges, it received majority votes from the PS (111), from the Liberal Initiative from the Bloco de Esquerda and the PAN parties , who wrote the text, as well as six deputies from the PSD and the Free Parliamentarian. Enough, the PKP and the majority of the SDP deputies (64) voted against.

The new text goes on to state that “medically assisted death can only occur by euthanasia when medically assisted suicide is not possible due to the patient’s physical incapacity.”

The diploma also clarifies the concept of “severe suffering”, which is now defined as “suffering as a result of a serious and incurable disease or permanent injury of extreme severity, of great intensity, persistent, prolonged or permanent, which is considered unbearable for a person.”

NEW REFERENDUM PROPOSAL
PSD MP Paula Cardoso announced this Friday that her party intends to once again propose a referendum on medically assisted death, to be held in the next legislative session.

DIPLOMA CHECKED
MP Isabel Moreira, one of the authors of the text on euthanasia, assured this Friday that there are “comfortable conditions” for the promulgation of the diploma by the President of the Republic. “The advantage of the legislature was tested as never before.”
