The parliamentary committee on constitutional issues, rights, freedoms and guarantees, at the request of Chega, postponed the finalization of the new decree on the decriminalization of violent death.
The consolidation of the final version of the text was scheduled for today’s meeting of the Committee on Constitutional Affairs, Rights, Freedoms and Guarantees.
Before the issue began to be discussed, the parliamentary leader Chegi demanded that it be postponed.
“A postponement is not possible, so there will be,” said MP Claudia Santos (PS), vice president of the commission that led the work.
Fixing the final version of the new decree on the decriminalization of violent death should be placed on the agenda of the next meeting of the committee.
In a conversation with Lusa, parliamentary leader Chegi said that the fixing of the final version of the certificate of death with medical assistance “entered only yesterday.” [terça-feira] at the end of the day on the agenda of today’s commission.”
“We didn’t have time to analyze the text,” MP Pedro Pinto justified himself.
On March 31, the Assembly of the Republic approved a new decree on medically assisted death with a positive vote from PS, IL, BE, two single deputies from Livre and PAN and six deputies from PSD.
The majority of the PSD bench (64 deputies) voted against, as well as five deputies from the PS and the Chega and PKP parliamentary groups.
There were also two abstentions, one from the PS and the other from the PSD, according to the results of the vote published on the Parliament’s website.
This review was carried out after the Constitutional Court (CC) declared the unconstitutionality of certain norms, as a result of which the President of the Republic was forced to veto a decree approved at the end of last year by Parliament.
This was the fourth time that the Assembly of the Republic approved a physician-assisted death certificate, a topic that had already been blocked twice due to unconstitutionality found by the TC and once due to a political veto by the President of the Republic.
According to the rules of procedure of the Assembly of the Republic, when the final version of the text is completed, the document will be published in the Journal of the Assembly of the Republic.
If there are complaints about inaccuracies, they can be filed by any deputy “until the third working day from the date of publication of the final draft text in the Journal.”
The Chairman of the Assembly of the Republic decides on complaints within 24 hours, the text continues, “deputies who file a complaint may apply to the plenary or to the standing committee before the meeting, immediately after the announcement of the decision.”
“The text on which no complaints have been received, or the text reached after decisions have been taken on the complaints submitted” is considered final, and after all this process, a parliamentary decree is sent to the President of the Republic, who can accept, veto or ask the Constitutional Court for preventive testing.
The new decree establishes that euthanasia can only occur through euthanasia if euthanasia is not possible due to the patient’s physical incapacity.
This is one of the amendments proposed by PS, IL, BE and PAN to the latest decree approved by Parliament, which was rejected by the Constitutional Court at the end of January.
