The announcement of this decision and the justification of Marcelo Rebelo de Sousa are contained in a note published on the official website of the President of the Republic on the Internet.
In this note, the head of state points out that “several proposals were made for the current diploma, as well as a specific proposal to link teachers, in the sense of making it more sustainable, without introducing additional inequalities to the existing ones.”
“Although neither the submitted proposal, nor another more minimalist one, was approved, at a certain point, proposed in dialogue with the President of the Council of Ministers, the President of the Republic considers it necessary to promulgate the present legal framework,” he adds.
Marcelo Rebelo de Souza states that he has decided, “in view of the publication by the government in Diário da República of Decree No. 111-A/2023 of April 26, which opens the competition for only two thousand teachers, for next year, based on the current wording of the law and because the new law has not been adopted and published and, therefore, has not yet entered into force.
On the other hand, he argues that “postponing the adoption of the law even within the statutory period of 40 days ending May 15, or not passing this law in this context, would mean postponing the expectations of about eight thousand teachers, in addition to being left without the consecration by law of some of their specific requirements adopted by the Government.
“For this decisive reason, the President of the Republic promulgated a Government Decree regulating the procedure for holding office and holding competitions for the selection and recruitment of teaching staff in the field of preschool education, primary and secondary education,” the head of state justifies.
With regard to this decree-law, the President of the Republic mentions that “The Civil Chamber under the President of the Republic followed very closely, in contact with the government and accepting trade union associations, both the current legal regime and the issue, the gradual restoration of the seniority of teachers has not yet been completed” .
At the end of this memo, Marcelo Rebelo de Souza once again calls for “to continue the dialogue with teachers, namely regarding the future of teachers, who are now bound for one year, and also regarding the phased restoration of the provided and not yet recognized teaching time. “.
“It would be important that the 2023-2024 school year is not, at least for some students and families, another eventful year that the previous three years were, for very different reasons,” he repeats.
On March 16, the government approved a decree-law establishing a new system for managing and recruiting primary and secondary teaching staff and technical specialists for training.
On April 10, the President of the Republic announced that he was waiting for answers to “a number of doubts” about this decree-law, which he submitted to the Government.
In Mursa, Vila Real district, where he went to open the Casa Museu Soldado Milhões, Marcelo Rebelo de Sousa was received by a group of teachers from different parts of the country, from Silves to Chávez, who asked him not to make the decree public. government, which they dubbed “a poisoned gift for all teachers.”
The head of state replied that he received his diploma about a week ago and that from that moment “the countdown of 40 days has begun, which can be extended in accordance with the dialogue that is being conducted with the Government.”
“It is a fact that since then I have also received long and detailed contributions during the Easter week from teachers from almost all unions,” he said.
Based on this, he added, “the President of the Republic sent a number of doubts to the government.”
“They were sent at the end of last week, I admit it was before Thursday, and now we are waiting for the government’s response on various issues that arise and we will see later before clarification,” he explained.
A review of the teacher recruitment regime has been discussed with trade unions in the industry for more than five months, and this process ended without reaching an agreement.
