Court rejects Robinho’s appeal and delivers a guilty verdict in Brazil rape case

Brazil’s Supreme Court (STJ) this Wednesday dismissed the appeal of former player Robson de Souza “Robinho” and took another step in the homologation process for the foul conviction the former player received in Italy.

The decision was made by a special court of the STJ, which unanimously rejected a defense request by the former Real Madrid, Manchester City and Milan player’s defense to translate the entire process in which he was sentenced to nine years in prison into Portuguese. .

Robinho, who is in Brazil, although without a passport and therefore unable to leave the country, was convicted by Italian justice of participating in the gang rape of a young Albanian woman at a disco in Milan in 2013.

The sentence is final, but the Brazilian constitution prohibits the extradition of its citizens, so the authorities of the European country requested the ratification of the sentence so that it could be carried out in Brazil.

A ruling in Robinho’s favor today could have extended the case by several months, but STJ magistrates decided to dismiss the defense’s appeal, reopening the process for a possible ratification of the verdict.

Thus, the former footballer’s lawyers, who have always denied the charges, now have 15 days to comment on the execution of the sentence in Brazil.

Consideration of the appeal to translate all judgments into Portuguese has dragged on since April in a special section of the STJ and was the result of a ruling by the judge investigating the case, Francisco Falcao.

In his decision, the judge argued that there was no appeal because Robinho was under the protection of his lawyers throughout the criminal proceedings in Italy, so there would be no reason to speculate about possible violations during the process.

This thesis was signed today by the remaining colleagues of the special section of the STJ, a body of fifteen judges.

The infraction happened in 2013 when Robinho was playing for AC Milan, at a club in the Italian city, and his friend Ricardo Falco, who was also convicted, was involved.

The decision is final and not subject to further appeal.

Robinho, a former Brazil international, has always denied the allegations and ensured that the sexual relationship was consensual.
