ISS explains that emergency closures occur “when there is an immediate danger to users,” and in these cases, “they are immediately removed and referred to other professionals identified by families or suggested by Social Security.”
“Decisions for users are always a case-by-case basis between family members and Social Security, which supports and informs them of alternative solutions, with the final decision being made by the family,” ISS explains.
Unless the closing is urgent, the closing must be completed by the owner within 30 days of notifying Social Security.
“After this period, non-compliance is reported to the prosecutor’s office and the perpetrators may be prosecuted for disobedience,” the SIS adds.
The Social Security Institute also states that 674 inspections were carried out in 2022 resulting in the closure of 117 care homes, all without a licence, and that in 21 situations emergency closure was justified.
It further explains that “the main reasons for the closure are due to the lack of an operating license or temporary operating permit; non-compliance of objects with the parameters established by law; poor accessibility, which jeopardizes the mobility conditions of older people.”
