According to the Prosecutor’s Office (MP), now the accused lawyer asked his clients to hand him a protocol on an administrative offense and filled out a driver’s license, identifying himself as the offending driver in all 555 cases identified in this process.
“According to the plan drawn up, they were familiarized and used, namely, the volume and rules for processing reports of administrative offenses in the ASSR. In addition to his actions requiring the creation of a new procedure for an administrative offense, the defendant sought to use all available legal means to ensure that the proceedings in the case were time-barred.
Due to his behavior, the lawyer was sought out by “numerous clients”, most of them companies, whenever a Highway Code offense notice appeared that failed to identify the driver.
The Director of the Traffic and Administrative Offenses Inspection Division, Anabela Arraiolos e Silva, who was questioned in the context of the trial, stressed that 1.2 million cases are submitted to ANSR every year, in which there are only eight lawyers and a service provider with a Catholic University. for process analysis.
“The lack of human resources with decision-making competence, given the volume of work, has led to the processes being timed out,” notes, emphasizing that in 2019 alone, in the context of the legalization of workers with precarious employment in public administration, 26 workers from Católica recognized their unreliable connection and integrated ANSR personnel, but this number is “clearly insufficient given the volume of processes requiring training”.
“He also explained that ANSR does not have any sector of analysis that focuses on incidents with specific offenders, and that the distribution of cases in the SIGA system is done randomly by ANSR lawyers, with the exception of lists of cases that are in the process of restriction.” , the Ministry of Health said in a statement.
