The lawyer is also accused of forgery and breach of trust. The Bar Association opened a disciplinary investigation. The case has now gone to court.
According to the prosecutor’s indictment, the defendant, as an agent of businessman Walter Pinto, “acted freely, knowingly and voluntarily” in conducting banking transactions that allowed him to embezzle his client’s money. In 2007, the lawyer deposited a check for 53 thousand euros into his account – an amount related to the inheritance of businessman Walter Pinto. Later, Alves Cayetano, also a representative of the commercial company Valter Pinto e Filhos, Lda, embezzled 705 thousand euros through a transaction that involved the sale of land in the Algarve for two million twenty-five thousand euros. Walter Pinto, 62, an expatriate from Australia, authorized a lawyer to represent him in his construction business. The lack of answers made him suspicious of the reports. “I feel deceived and betrayed. I want justice,” said Walter Pinto. CM.
“The defendant took advantage of the fact that Walter Pinto lived abroad and over the years created in him the belief that he had not received the check in question and the amount indicated on it. By acting in this way, the defendant intended to obtain a property advantage for himself, as in fact he received it,” explains the prosecutor’s office of Loule.
