The Guimarães Court of Appeal has decided to prosecute a Barcelos woman for child abduction and domestic violence who fled the country with her minor daughter, whose custody was entrusted to her father, it was announced on Wednesday.
In a note published on his page, the Prosecutor General of Porto states that the woman was initially sentenced by the judge of the criminal investigation of the Braga court solely for the kidnapping of a minor.
The Public Prosecutor’s Office (MP) filed an appeal, and now the court, in a ruling dated May 7, has decided that the woman will also be tried for domestic violence.
The deputy believes that the defendant broke up with the girl’s father when she was less than a year old, having gone through the procedure for regulating the fulfillment of parental responsibilities.
At that time, the court placed the child in the custody and care of the mother, allowing the father to visit her when he decided, with prior notice, to take her with him on alternate weekends and spend four weeks of vacation with her every day. year, in two periods of fifteen days.
Also, according to the deputy, since May 2005, the defendant “formulated the intention to make it impossible for the girl to have contact with her father and other members of her father’s family, so that they would not develop or even begin to collapse.”
To do this, among other things, “the girl was held accountable against her father and his family, he repeatedly failed to respect the girl’s relationship with her father and procedurally raised false suspicions of sexual abuse against her father.”
For these suspicions, “they were pointed and put pressure on the girl’s messages.” [nascida em 2003]so that they fit such a false narrative.”
Between April and October 2010, the accused left with her daughter for Brazil, depriving them of the opportunity to communicate, attend school and receive psychological support for her pre-existing disorders.
Finally, reacting to the decision of the court, which, by a verdict of November 17, 2011, determined a change in the order of parental responsibilities, transferring the girl to the guardianship and care of her father, the defendant “fled the country.” , taking the girl with him.”
Thus, the father lost sight of his daughter.
The deputy wanted the child’s maternal grandmother to be tried as well, but this request was rejected.
